Terms & Conditions:

These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales, and any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

By purchasing a fishing ticket you are acknowledging and accepting ALL of our rules and terms and conditions.

The booking is confirmed upon receipt of a deposit of 50% of the total cost. The balance must be paid at least 6 weeks prior to the start of your booking. If your booking is placed with less than 6 weeks to the start date of your session, we will require payment in full.

Please note, by booking fishing or hiring holiday accommodation you accept and agree to be bound by these Terms.

Issue of a fishing ticket confirms a 'right to fish' only for the named holder in the swim booked and for the period stipulated on the ticket only. All tickets remain the property of Carp Luxe / Luxe Lakes and must not be tampered with or altered in anyway. Tickets are non- transferable nor has any person other than the named ticket holder any right to enter Carp Luxe / Luxe Lakes property by authority of that ticket.

Ticket holders may use rod and line only and must not fish by any other means. Landing nets may only be used for fish hooked with rod and line.

Any ticket holder having their ticket withdrawn or cancelled in accordance with the rules will lose their entitlement to fish or enter onto Carp Luxe / Luxe Lakes with immediate effect.

In the event of withdrawal or surrender of any ticket for any reason or cause whatsoever, no refunds shall be payable by the owners of Carp Luxe / Luxe Lakes. Any cancellations of tickets will not be refunded or transferred to other dates or anglers.

Carp Luxe / Luxe Lakes reserves the right to refuse the issuing of tickets at its absolute discretion.

Ticket holders and visitors who enter onto Carp Luxe / Luxe Lakes property do so entirely at their own risk and are warned that it is dangerous to depart from permitted pathways and fishable swims. Carp Luxe / Luxe Lakes makes no representation or gives any warranty as to the conditions of the venue, this is a natural environment and circumstances or conditions may prevail over which Carp Luxe / Luxe Lakes has no control. As such Carp Luxe / Luxe Lakes accepts no liability whatsoever, including death or personal injury caused by its negligence, or the negligence of its employees or agents.

No liability whatsoever will be accepted by Carp Luxe / Luxe Lakes, their employees or agents, for any loss or theft of, or damage to vehicles, tackle or personal belongings, including clothing, however caused, whilst on Carp Luxe / Luxe Lakes property.

CCTV is in operation at various locations at Carp Luxe / Luxe Lakes. All of our stock are micro chipped. All fish caught must be returned to the water unharmed. The removal of fish from our venue will be viewed as a criminal act.

CCTV is in operation at various locations at Carp Luxe / Luxe Lakes. During your visit your image may be captured by one or more of these devices. By visiting our Carp Luxe / Luxe Lakes you accept that you may be filmed either for the production of stills or video. These images may be used within products such as commemorative photographs. Footage may also be used for promotional purposes.

In the interest of security and fish welfare Carp Luxe / Luxe Lakes reserves the right to ask to examine any vehicle on or leaving the venue in the presence of the driver. Refusal to co-operate will be taken as an infringement of the rules and may result in termination of your ticket. Anyone found contravening rules will automatically have their ticket and access rights immediately withdrawn and could face prosecution.

Weather conditions and subsequent natural events such as flooding and freezing are natural occurrences beyond the control of Carp Luxe / Luxe Lakes and as such refunds will be at the discretion of the owners. In this situation refunds may take up to 30 days if issued. The owners of Carp Luxe / Luxe Lakes are not liable to pay refunds or offer future discount provided for periods when the lakes are un-fishable.

Luxe Lake reserves the right to close, without warning if absolutely necessary, all or any part of the fishery for the protection of the welfare of the fish stocks and no refund will be payable, alternative fishing session options will be offered by Carp Luxe / Luxe Lakes on a case by case basis.

Carp Luxe / Luxe Lakes reserves the right to close individual swims, sections of bank, or access pathways for planned or emergency repair or maintenance works and no refund will be payable or future discount provided by Carp Luxe / Luxe Lakes. Any planned closures will be displayed on the Carp Luxe / Luxe Lakes website and on site notice board.

Carp Luxe / Luxe Lakes reserves the right to carry out unplanned general maintenance works such as grass cutting, tree trimming and path/swim maintenance at any time without notice. This may cause some noise and disturbance but no refund will be payable or future discount provided by Carp Luxe / Luxe Lakes.

Carp Luxe / Luxe Lakes reserves to itself the right, at its absolute discretion, to amend the rules when and where it thinks fit. Any rule changes will be displayed on the Carp Luxe / Luxe Lakes website.

Any matter arising not currently covered under the existing rules is at the sole discretion of Carp Luxe / Luxe Lakes.

Carp Luxe / Luxe Lakes reserves the right to use any photos taken on the venue, this includes for use in advertising and social media. Photos may contain images of anglers with fish or film footage including drone footage. By purchasing a ticket you are acknowledging and accept the use of your images for these purposes.

Tree climbing is not permitted on any part of Carp Luxe / Luxe Lakes property and any persons injured as a result of tree climbing shall be solely responsible for their actions and Carp Luxe / Luxe Lakes owners accepts no liability whatsoever, this includes death or personal injury caused by negligence of the Carp Luxe / Luxe Lakes rules.

Ticket holders and visitors who enter onto Carp Luxe / Luxe Lakes property do so entirely at their own risk.

Cancellation

50% non refundable deposit.

We will move your booking once to the nearest suitable date as long as there is a 6 week window before arrival.

Carp Luxe / Luxe Lakes reserves the right to cancel bookings. Reasons for cancellation may include, but without limitation:

• Violent, racist, or verbal abuse towards any person on our site;
• Failure to comply with the laws of England and Wales;
• Refusal or failure to pay the correct fee;

We strongly recommend that you take out the appropriate travel insurance when you book your stay, to cover you if you are unable to visit us. We do not offer any holiday insurance products, and these must be purchased independently.

Changes to These Terms:

We reserve the right to make alterations or changes to these Terms at any time ensuring that the Customers of existing bookings will receive the latest copy of the Terms prior to participating in an Adventure. Should the revised Terms be unacceptable to a Customer who has pre-booked the booking may be cancelled without penalty or administration charge.

EVENTS OUTSIDE OF OUR CONTROL

1. We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under an Agreement that is caused by an Event Outside Our Control. An Event Outside Our Control is defined below in Condition 26(b).
2. An Event Outside Our Control means any act or event beyond our reasonable control, including without limitation strikes, lock-outs or other industrial action by third parties, civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war, fire, explosion, storm, flood, earthquake, subsidence, epidemic/pandemic or other natural disaster, or failure of public or private telecommunications networks or impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport.
3. If an Event Outside Our Control takes place that affects the performance of our obligations under this Agreement:
   1. we will contact you as soon as reasonably possible to notify you; and
   2. our obligations under an Agreement will be suspended and the time for performance of our obligations will be extended for the duration of the Event Outside Our Control.

COMPLAINTS AND DISPUTES

Any disputes or complaints must be brought to the attention of Carp Luxe / Luxe Lakes in writing within fourteen (14) days from the occurrence which gave rise to the complaint / dispute. On receipt Carp Luxe / Luxe Lakes will respond within 14 days in writing. Carp Luxe / Luxe Lakes will endeavour to investigate and resolve such a dispute or complaint without involving third parties. In the event of a complaint or dispute not being satisfactorily resolved both Carp Luxe / Luxe Lakes and the customer hereby agree that the dispute will be settled and determined by arbitration pursuant to the laws of England and Wales under the provision of the Arbitration Act of 1996.

GENERAL MATTERS

1. We may transfer our rights and obligations under an Agreement to another organisation, but this will not affect your rights or our obligations under these Terms.
2. This Agreement is between you and us. No other person shall have any rights to enforce any of its terms, whether under the Contracts (Rights of Third Parties) Act 1999 or otherwise.
3. Each of the Conditions of these Terms operates separately. If any court or relevant authority decides that any of them are unlawful or unenforceable, the remaining Conditions will remain in full force and effect.
4. If we fail to insist that you perform any of your obligations under these Terms, or if we do not enforce our rights against you, or if we delay in doing so, that will not mean that we have waived our rights against you and will not mean that you do not have to comply with those obligations. If we do waive a default by you, we will only do so in writing, and that will not mean that we will automatically waive any later default by you.
5. If you are a consumer, please note that these Terms are governed by the law of England and Wales. This means an Agreement for a purchase of through our site and any dispute or claim arising out of or in connection with it will be governed in accordance with the law of England and Wales. You and we both agree that the courts of England and Wales will have non-exclusive jurisdiction. However, if you are a resident of Northern Ireland you may also bring proceedings in Northern Ireland, and if you are a resident of Scotland, you may also bring proceedings in Scotland.
6. If you are a business, an Agreement and any dispute or claim arising out of or in connection with it or its subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of England and Wales.
7. If you are a business, we both irrevocably agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with an Agreement or its subject matter or formation (including non-contractual disputes or claims).
